TERMS AND CONDITIONS

Please ensure you have read and understood these Terms and Conditions before you complete your booking; they are subject to change so please ensure you have read the latest version at the start of your event.

Payment and Inclusions
Full payment must be made in advance of your event, prior to the payment date noted on your booking form. It is not possible to attend the event unless payment has been made and received prior to the start of your event.

Currently we accept payment by BACS (account name: Mr Adam Marsh | account number: 61493914 | sort code: 401610 | payment reference: “SURNAME” “DATE OF COURSE YYYYMMDD” ie. MARSH20200101); cheque (made payable to Adam Marsh) or in cash.

The price includes tuition, materials, use of tools and equipment, and light refreshments including tea, coffee and squash. Food will not be provided but if you book onto a full day course then refreshments can be brought along and consumed in the garden or under the covered way. No food or drink should be consumed in the studio.

There is an additional cost for firings; this is charged at £2 per pound (in weight) for each firing.

Damages
Behavior which is deemed of an offensive or unacceptable nature will result in admittance into the studio being refused and no compensation given for future loss of service. Additionally, we reserve the right to charge for damages caused by misconduct or recklessness. Legal action will be taken in extreme cases where agreement cannot be achieved by all parties.

Cancellation and Non-Attendance
Cancellations must be made in writing by post or email and are subject to the following fees:
Cancellations within 14 days of the start of your event will be charged the full event fees.
Cancellations between 15-28 days of the start of your event will be charged 50% of the full event fee.
Cancellations more than 28 days of the start of your event will be charged 25% of the full event fee.
If a participant fails to attend the event, the full event fees are payable. Under the Customer Protection (Distance Selling) Regulations 2000 (“Distance Selling Regulations”) you may cancel your purchase of an event within a period of seven working days beginning on the day after booking confirmation has been sent. However, there is no right of cancellation where the event begins within this seven-day period.
If you are unable to attend class (including due to sickness, bereavement or an act of god out of your control) no make up classes, credit or refund will be offered outside the cancellation details above.
If we are unable to run an event we will rearrange at a comparative time for all affected. If you are unable to attend no refund or credit can be offered.
Cancellations which affect other students will be treated as non-attendance. If a course has to be cancelled or rearranged as a result of a student cancellation, no refund, credit or alternative will be offered to that student.

Delegate Substitution
A substitute delegate may be named at any time before the event at no additional cost (this must be for the whole course in full; individual substitutes will not be accepted to “share” the course).

Transfer Requests
A request to transfer to an alternative event or date must be made in writing by post or email. Transfers may be made up to 14 days prior to the start of the event and will incur no additional cost. However, transfers are subject to availability and Adam Marsh is not obliged to ensure suitable alternatives are available. A booking an only be transferred on one occasion; requests for subsequent transfers will be treated as cancellations.

Late Attendance
It is to the discretion of the tutor to not accept a late arrival to a course if it is potentially detrimental to fellow students. This will be treated as a late cancellation or non-attendance.

Course Content
Adam Marsh reserves the right to change the content, timing, date and venue of the event in order to provide a high-quality service or where it is necessary for reasons beyond our control. Adam Marsh reserves the right to cancel a course up to and including the date of the course if insufficient bookings have been received and will strive to give as much notice of this as possible. Individuals booked onto a cancelled course will be given a credit towards the purchase of pots, a gift voucher or the rescheduling to a future course or event (subject to the nature of the cancellation as above).
Adam Marsh will not be liable for any losses or expenses arising from amendments to the course or cancellations.

Intellectual Property
Course materials are supplied only for your personal use. Adam Marsh remains the owner of all intellectual property in course materials. No part of the materials may be copied or reproduced without permission.

Health and Safety
Adam Marsh takes a diligent approach to health and safety for the sake of all staff and users. Students are agreeing to read and abide by the guidelines of our Health and Safety policy. Repeated failure to do so will result in immediate termination of the event without refund.

Technical issues and breakages
By the nature of ceramics there is always a risk of technical failure for which we cannot be held responsible. Money paid for firing is non-refundable.

Collection of Works
Finished work should be collected as soon as possible after your event to help keep our storage area clear therefore avoiding damage. If finished ceramic work is not collected within 2 months of the end of the event we will sadly have to dispose of it. Please bring packaging with you when collecting your work or a contribution towards packaging costs.
If you are unable to collect your work, then we may be able to post it to you, but postage and packaging must be paid for by the participant. Adam Marsh does not hold any responsibility for any damage during the postal process and payment must be made in advance (to include packaging materials used).

Use of Work
Adam occasionally has a student exhibition of work made at his studio. Adam may request for you to participate in this. You have no obligation to display your work and this remains at your discretion. If you would like to be involve then details can be discussed with Adam on an individual basis.

Exclusion
Adam Marsh reserves the right to refuse access to the facilities and premises where there is reason to believe that these conditions have been breached or where threatening, bullying, harassing or disruptive behavior has occurred.
Adam Marsh will not be liable for any losses or expense (including fees and consequential damages) incurred by anyone working in the studio.

Data Protection
Any personal information you give us will be processed in accordance with the Data Protection Act 1998. We will use the information to process your booking to provide the event and to inform you about similar courses which we provide, unless you tell us that you do not want to receive this information.
Any personal data you provide may be held on computer files.

Applicable Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with English law and any dispute arising out of or in connection with them shall be settled by the English courts.

Photography
Adam Marsh may take photographs of your course and any work you create during any of his events for use on his website, promotional material and social media. Please discuss in advance if you have any concerns about this. By completing your booking it is deemed that you accept for your image and that of your work to be used for promotional purposes by Adam Marsh.

Response to Covid-19
If you or anyone within your proximity have any coronavirus symptoms, we would encourage you not attend class until symptoms have ceased.

Class sizes reduced in the studio as a result of the pandemic; a maximum of 5 students + Adam (and any teaching/ class support) however will continue as a result of my 2022 Spring Student Survey.

Students are asked to bring their own apron to class where possible; some will be made available but this will remain limited.

Each student will be provided with a personal visor to wear during class should they wish to use them. Face masks are no longer mandatory however should you wish to continue to wear a mask or shield this will be supported. Face masks are encouraged should you have any covid symptoms or if you are recovering from a suspected case of covid.  This is as a result of my 2022 Spring Student Survey.

We could still encourage that students maintain social distancing throughout class where practicable. It is understood that this may not be possible due to the nature of the classes but please make every attempt as best you can. 

Antibacterial hand gel will still be available in the studio for use throughout sessions as required. 

Increased studio cleaning will remain but to assist this please make sure that you allow sufficient time at the end of each workshop/ class/ session to help wash up any equipment used. Please also wipe down communal equipment used once you are finished throughout the class. 

Refreshment breaks will continue to take place outside (under the covered way during bad weather) but no restriction of consuming food/ drink within the studio shall remain.
